Under current guidelines set by the Accreditation Council for Graduate Medical Education (ACGME), medical residents cannot work more than 30 hours per shift and 80 hours per week, averaged over four weeks. However, the ACGME's only method of enforcement, revoking accreditation status, is punitive and unfair for residents. "The ACGME's enforcement mechanism is inadequate and discourages residents from reporting violations for fear of jeopardizing their professional careers," says Lauren Oshman, M.D., M.P.H., National President of ŷAƬ. "AMSA strongly believes the current system must be replaced by federal guidelines to adequately protect physician-in-training and patients." The Patient and Physician Safety and Protection Act of 2003, introduced by Senator Jon Corzine (S.952) and Representative John Conyers (H.R.1228) would enforce work hour regulations through civil penalties rather than a loss of accreditation. The legislation would also provide whistleblower protection, public accountability and the appropriation of additional funds for hospitals to hire additional staff. The ACGME does not currently accept anonymous complaints, and medical residents are not afforded proper guarantees of confidentiality if they report a violation. "This legislation is necessary to close loopholes in the new regulations, protect resident physicians and provide patients with information about programs that risk patient safety by working residents long hours with little sleep," says Oshman.
